SPAIN, Madrid: Has a single judge the competence and legitimacy needed to investigate the crimes of Franco dictatorial regimen or not may be an empirical debate among legal practitioners for hours. What must be clear is that in any democratic state the power is vested by the people, and they being the owners of the democracy choose to entrust it, as it is well described in the art. 1.2 of the Spanish Constitution to judges (the judiciary power), congressmen and parliamentary (the legislative power) as well as the government (the executive power).

Although each of these powers, according to Montesquieu's the Spirit of the Laws, is independent of each other, yet all of them depend on the will of the people and they chose to show their support for judge Baltasar Garzon attending a massive event that dyed the route from the Plaza de Cibeles to Sol (Madrid, Spain) in black and white - the colors of the old photographs turned banners, portraying the victims of Francisco Franco's dictatorial regimen, whose crimes the judge wanted to investigate before the ultra right wing Spanish Falange and the Clean Hands Collective accused of malfeasance.
